Safety, then photos
Look up before you walk toward the car. Limbs that broke but did not fall can come down later, and storm-felled trees in Atlanta neighborhoods often bring a line with them. If a wire is on the tree or the car, keep back and call the utility (see Tree on a power line).
Then photograph everything from several sides: the car, the tree where it lies, where it broke or uprooted, and the stump if it is in a neighbor’s yard. Those pictures matter for the car claim and, if the tree was someone else’s and visibly dead, for any later claim against its owner.
Which policy pays
State insurance regulators describe the same pattern: a tree on a car is a matter for the car’s insurance, and it is covered when the policy includes comprehensive coverage. Liability-only policies do not pay for damage to your own car. A homeowners policy is generally not where car damage goes, even when the tree came from your yard.
Who owned the tree matters less than it seems. In Georgia, the owner of a tree is liable for what it damages only if the owner knew, or reasonably should have known, that it was diseased, decayed or dangerous, according to the University of Georgia Extension. A healthy tree blown over in a storm is usually nobody’s fault, and each owner claims on their own coverage.
Getting the tree off
A trunk across a hood or a roof is under tension. Cut in the wrong place, it springs or drops and does more damage than the fall did. A crew lifts it off in pieces, sometimes holding sections with ropes or a loader so they come up rather than down. If the car is on a public street and the tree came from the right-of-way, that is the city or county’s tree; Atlanta’s Parks and Recreation handles trees on city land.
The tree afterward
If the tree landed only on the car and the yard, the homeowners policy usually pays nothing to remove it: Georgia’s regulator says the debris coverage applies when the tree damaged a covered structure such as the house. Removing the rest of the tree from your yard is then the owner’s cost. See What changes the price.
